Rental Amendments to the Master Deed.
There is a 30 unit rental cap. A maximum of 30 units May be rented, leased or otherwise occupied by an individual who is not the unit owner or the unit owner’s immediate family member at any time. For purposes of this amendment, an immediate family member shall be a spouse,significant other, child, parent, grandparent,niece,nephew, or sibling of the unit owner.
Once the rental cap has been met, a unit owner May apply to the Board of Trustees for permission to rent their unit and the unit owner's name will be added to the rental waiting list. The waiting list will be in the order that the rental requests have been received. Any and all units owned by the Summerwood Condominium Trust shall exercise priority over all other rental requests and rental waiting list.
Rental Eligibility- No unit owner may lease a unit to a third party or be eligible for the rental waiting list unless they or a member of their immediate family has occupied the unit as a principal or secondary residence for at least 1 year prior to the request or be placed on the waiting list,
a. No unit, other than the whole, shall be rented, let, leased, or licensed for use or occupancy by other than the owners thereof, except to persons who have signed a standard lease form.
All Unit Owners are required to submit to the Board of Trustees a copy of the lease at least 21 days prior to the start or renewal of a lease for approval. New lease applicants may not have their unit occupied until the lease is approved.
An owner’s failure to comply with this requirement will result in an automatic fine in the amount of Two Hundred ($200.00) Dollars. Once signed, the owner of the leased unit must furnish a copy of the lease agreement to the Summerwood’s Management office within five working days of signing, along with an updated Census Form.
b. Any unit which is leased must be persuant to a lease agreement showing a term of 1 year. Month to month lease agreements, even those which were previously for a 1 year term are prohibited, unless written permission of the board. No month to month continuation of a lease.
Unit owners are required to provide their name,residential address and email address to the board. A current unit census must be on file or filled out All information needs to be kept current.
All Summerwood leases must state: the tenants have read,understand and agreed to abide by all of Summerwood Condominium Trust Master Deed, Declaration of trust and the Rules and Regulations and irepeated violations are grounds for lease termination.
No pets are allowed in the unit.
The lease must state the names of all persons who are allowed to live in t he unit and that no persons other then those listed on the lease are allowed to reside in the unit. No visitors are allowed to stay in the unit for longer than 14 days without the written permission from the owner. Resident parking decals must be obtained within 10 days of move in. The basement cellar cannot be used as a bedroom/sleeping quarters. Repeated violations of any terms of the lease are grounds for lease termination.
c. Unless approved by the Trustees, a residence may not be rented more than once in any twelve-month period or occupied by anyone other than the owner for more than fourteen (14) consecutive days without a lease. If a unit has not been rented leased,or licensed within 30 days of the expiration or termination of a lease, the board will notify the unit owner in writing, the unit will no longer qualify for rental, at which time the unit owner may apply to be on the unit rental waiting list. A rental cap exception May be requested on the sole discretion of the Board of Trustees due to extraordinary circumstances. The Board, may, if approved, place further conditions of rental.
No weekly leases, monthly leases, or tenancies at will (month to month) are permitted. No summer rentals (Memorial Day through Labor Day) are permitted.
d. Unit Owners are responsible for all actions of their Tenants and lessees including the payment of any or all fines levied by the Board of Trustees as the result of the Tenants and lessees’ actions. This includes the tenants guests,invitees, agents, and service personnel.
e. Unit Owners must provide information requested by the Board of Trustees as to the names and other information regarding unit residents whether Tenants or owners, for each unit he/she owns including such information as the number of people occupying the unit. The Unit Owner must update this information within ten (10) days of any change.
f. Any maintenance problems that the Tenant may incur are to be reported to the Owner, the Owner will then contact the maintenance personnel or the Board of Trustees. In the event of an immediate emergency, and the Owner is unable to be reached, the tenant will contact the maintenance personnel or the Board of Trustees first, then the Unit Owner.
g. Tenants are not allowed to vote or hold and elective office on the Board of Trustees. However, they may participate on Committees, which do not have a direct affect on the operations of Summerwood.
h. All Tenants will report problems with their units to their landlord. In the event of an emergency the Tenant will contact the maintenance personnel or the Board of Trustees.
i. If a tenant has any complaints or concerns regarding the daily operations of Summerwood Condominium Trust, he or she is to address those complaints or concerns directly with the owner of their unit, NOT with Summerwood Condominium Trust.
j. Tenants are prohibited from keeping pets. Violation of this regulation will result in an initial fine to an owner in the amount of Two Hundred ($200.00) Dollars and additional daily fines until the pet is removed.
k. The right to use trash disposal and common area amenities such as the pool and tennis courts is exclusive to residents and is no one else. Pool keys are the responsibility of the unit owner and if lost or misplaceed, a $100 replacement fee will be required.
